How To Apply for the H-1B Visa
I’ve been getting a lot of questions this week about how to apply for the H-1B Visa. That’s because USCIS has completed the March lottery and companies are starting to receive their selection notifications.
In order to apply for an H-1B visa this year, you must do four things:
The first is you must be an employer who has a selected H-1B registration. If you failed to register for the lottery in March, it’s too late to now. You will need to wait until March 2021 to start the process. If you are an employee and your employer has notified you that you’ve been selected, you cannot submit an application on your own. Your employer must submit the petition for you.
The second is you must be offering your employee a position that is considered a specialty occupation. A specialty occupation is a jog that requires at least a four year college degree or the equivalent. If the job does not require a four year college degree, it is not a specialty occupation and your petition will not be approved.
Third, you must apply for and receive a Labor Certification from the U.S. Department of Labor. This process can sometimes take a few weeks, so don’t put it off!
Finally, you must file your H-1B Petition by June 30, 2020.
