How Can I Move Up My Immigration Court Hearing?
In today’s world of immigration court backlogs lasting years and years, I’m often asked if it’s possible to move up an Immigration Court hearing date.
Here in Dallas, for example, we are seeing cases set into 2023 and after. There is no end in sight for the lengthy delays.
In some cases of extreme urgency, it is possible to request the court move up your hearing date. We do this by filing what we call a “Motion to Advance.”
Not all courts and judges will be willing to entertain such a motion. You certainly need the right kind of facts and strong evidence. A good example is if you or a dependent will no longer be eligible for the relief you are seeking if your date is not pushed forward.
Motions to Advance are complicated. You should never risk annoying your judge by filing this motion on your own. It may be seen as frivolous and damage your case and your reputation with your judge.
